“OUR GENERAL TERMS OF SALES”

Ordering on www.arsenrock.com web site, the buyer has read these Terms and Conditions.

These Terms are for non-commercial individuals. The parties agree that their relations will be exclusively governed by these Terms and Conditions, to the exclusion of any conditions previously available on the website. If the User does not agree to all of these Terms, he shall order in no case.

ARTICLE 1. DEFINITIONS
1.1. User means any person who browses, orders and/or purchases item on the online store www.arsenrock.com. 1.2. Product means any item displayed on the online store (website). 1.3. Online store (website) is the infrastructure developed by the retailer according to computer formats used on the Internet including different types of data, including text, sound, still and moving images, videos, databases, to be consulted by the user to find products and services. 1.4. Internet means different network servers located in various places around the world, linked together using communication networks, and communicating with a specific protocol known as TCP / IP.

ARTICLE 2. SUBJECT
These conditions aim at defining the terms of sale between the seller (ARSEN ROCK) and the user of the ordering after sales services, through payment and delivery. As mentioned above, these Terms as related non-exclusive commercial individuals.

ARTICLE 3. ORDER
The user can order online on www.arsenrock.com. The order can be registered on the site if the user is clearly identified by entering their username and password (which are strictly personal to him). Any order implies acceptance of the prices and descriptions of products available for sale. Any dispute on this point will occur in the context of a possible exchange and guarantees mentioned below. The user can change his basket before the final validation, this last step formalizing the sale contract between the seller and the User. Indeed, when the user clicks on the button after checkout process, he/she agrees with the terms of sale. The Seller reserves the right to cancel or refuse any order from a user with whom there is a dispute over payment or abuse related to a previous order. The Seller undertakes to fulfill orders received on the website only within the limits of available stocks. In case of unavailability of the product, the Seller undertakes to inform the user.

ARTICLE 4. VALIDITY OF ORDER
Any User who does not hold a customer account site must follow a procedure of registration to obtain their account. This account is strictly personal. If you forget your password, a link allows the user to receive a new username and password.

In all cases, communication online credit card number and the final validation of the order shall be evidence of the whole of the said order in accordance with the March 13th, 2000 Act and will be worth payment of amounts incurred by the command. Data on computer or electronic evidence is valid and as such, are admissible under the same conditions and with the same force as any document created, received or kept in writing. The filing of purchase orders and invoices is made on a reliable and durable base so as to correspond to a faithful and durable copy in accordance with Article 1348 of the Civil Code.

ARTICLE 5. DELIVERY
The products offered in the online store www.arsenrock.com are available for delivery in Metropolitan France, overseas territories and International.

ARTICLE 6. PRICE
Prices are quoted in euros, 20% VAT. These prices do not include shipping, depending on the amount of force. Any change in the applicable rate may be reflected in product prices. The prices can not be changed once the customer order placed. Similarly, if one or more taxes or contributions, including environmental had to be created or modified, upwards or downwards, this change will be reflected in the selling price of the items on the site of the Seller. The price of the items ordered on the site and the date of the order in question are authentic.

ARTICLE 7. PAYMENT
ARSEN ROCK uses Paypal for online payments. Paypal allows us to safely process your credit card payments and complete the financial transactions as securely as possible. For further information regarding Paypal’s secure systems please visit their website www.paypal.com.
No banking information is transmitted to us. Your card number will never be known or stored.

ARTICLE 8. RIGHT OF RETURN / RETURN / EXCHANGE / BE
To order, the customer has a right of withdrawal from 7 days (= a 7-day right of withdrawal) from the date of receipt of the package, in accordance with Article L.121-20 of the Consumer Code, without having to give reasons or pay penalties.
The return package tracking (all the elements provided by ARSEN ROCK), ensuring the re-shipping, remains the responsibility of the customer.
This right of return will not be accepted for products returned in perfect condition, in their original packaging and accompanied by a copy of the invoice within 7 days. Items returned incomplete, damaged or soiled by the User will not be repeated. Stamp the postmark, no returns will be accepted beyond 7 days.

To make a return, the customer must:

  1. Access their order history, from his personal account on the website www.arsenrock.com
  2. Select the product (s) (s) he wants to return
  3. (Optional) Add an explanation, for the sake of quality

Upon receipt of the return, ARSEN ROCK send as soon as possible an email confirming the refund of the order. This reimbursement will be made available to the customer and used to have.
For an exchange, if the new order is in excess, the user must join the exchange request for the balance. Conversely, if the amount of the exchange is less than the original amount, the User will receive upon receipt of a request have to refund the difference. For defective products delivered, the User has a period of 3 days to notify the Seller reserves all being understood that any claim made after this deadline will not be accepted and the user must return the product in question in the state in which it was received and in its original packaging . ITEM 9. GUARANTEE
All products are subject to a legal guarantee of conformity (Articles L.211-4 and following of the Consumer Code) and a guarantee against hidden defects (Article 1641 of the Civil Code), which allow the user to return Defective items.
Furthermore, the customer receives a free one-year warranty (from the date of purchase + 7 days) on the product.
During this one-year period, ARSEN ROCK will exchange once a piece of equipment, any broken parts such as: branches, face or sunglasses. The manufacturing plant would no longer have the necessary documents, ARSEN ROCK will exchange with a similar model defective components and defray any costs.

ARTICLE 10. PERSONAL DATA
The Seller reserves the right to collect data on the user, including the use of cookies. The Seller may, for commercial reasons, transmit to a trading partner’s identity and contact information of users of services. The user can explicitly oppose disclosure of their details when ordering. For that it is enough for him to announce by filling out the contact form from the site.
According to the law of January 6, 1978 as amended, the user has a right of access, opposition and rectification of data concerning via the site.

ARTICLE 11. LIABILITY
The Seller for all stages of order taking, as well as subsequent to the conclusion of the contract (transport of products, for example) an obligation of steps. The Seller undertakes to describe with great accuracy the products sold on its site. In all cases, Seller’s liability could be incurred if the breach of its obligations would be due to an unforeseeable and insurmountable third contract is a case of force majeure as defined by the law French (=French legislation). ARTICLE 13. LASTING
These conditions apply throughout the duration of online products offered by the Seller.

ARTICLE 14. ENTIRE AGREEMENT
The parties acknowledge that this Agreement constitutes the entire agreement between them and replaces any offer, provision or prior agreement, oral or written.

ARTICLE 15. MODIFICATION OF CONTRACT
No subsequent document, no modification of the contract regardless of the form shall be effective between the parties without taking the form of an endorsement dated and signed by them.

ARTICLE 16. VOID
If any provision of this contract shall be invalid under a rule of law or a court decision becomes final, it would be deemed null and void, without invalidate the contract or alter the validity of the remaining provisions.

ARTICLE 17. WAIVER
The fact that one or the other party does not claim the application of any provision of the contract or acquiesces in its breach, either permanently or temporarily, shall not be construed as a waiver by that party rights arising for it from that clause.

ARTICLE 18. DOMICILIATION
The parties elect domicile at the address indicated on the order form for the user and the address on the site for the Seller.

ARTICLE 19. APPLICABLE LAW AND DISPUTES
These general conditions of sale are subject to French law. The language of this contract is the French language. In case of dispute, the French courts will have jurisdiction.
